DMCA / Copyright Policy

This policy describes how Kasted responds to claims of copyright infringement under the Digital Millennium Copyright Act.

1. Removal of Infringing Content

Kasted respects the intellectual property rights of others and expects Platform users to do the same. Kasted will respond to valid DMCA takedown notices by removing or disabling access to allegedly infringing content. Kasted may also remove content at its discretion under the Terms of Service and Community Guidelines.

2. Designated Copyright Agent

Notices of claimed infringement should be sent to Kasted’s Designated Copyright Agent:

3. Submitting a Takedown Notice

Misrepresenting that material is infringing may expose you to liability under 17 U.S.C. § 512(f).

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material and information reasonably sufficient to locate it on the Platform.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature.

4. Counter-Notices

If a valid counter-notice is received, Kasted may restore the removed material in 10 to 14 business days unless the original complainant notifies Kasted that it has filed a court action seeking to restrain the alleged infringement.

  • Identification of the material that was removed and its location before removal.
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Kasted may be found.
  • A statement that you will accept service of process from the person who provided the original notice or their agent.
  • Your physical or electronic signature.

5. Repeat Infringers and Other IP Claims

Kasted will terminate, in appropriate circumstances, the accounts of users determined to be repeat infringers. Kasted may also limit, suspend, or terminate accounts involved in infringement at its discretion.

Trademark, publicity rights, and other intellectual property complaints may be sent to contact@kasted.co with a description of the claimed rights, the allegedly infringing material and its location, and your contact information.
