Terms of Service

Kasted is a web-based creative industry marketplace and workflow platform connecting talent, agencies, brands, and creative professionals. The Platform provides software tools for portfolio hosting, talent discovery, creative briefs, casting calls, opportunities, applications and submissions, representation and agency-routed workflows, agency roster management, professional networking, in-app messaging, and subscription-based access features.

Kasted is a technology platform only. Kasted is not a talent agency, modeling agency, booking agency, employment agency, employer, recruiter, staffing agency, manager, party to user agreements, or guarantor of work, compensation, payment, safety, or professional outcomes.

Use of the Platform does not create any employment, agency, representation, partnership, joint venture, or fiduciary relationship between Kasted and any user.

Kasted does not procure, promise, negotiate, secure, or attempt to secure employment, engagements, bookings, auditions, or paid work on behalf of any talent, creative professional, agency, or brand, and does not negotiate compensation or contract terms on behalf of any user.

Kasted is not licensed as a talent agency under Florida, California, New York, or any other state or federal law.

Users — including agencies and brands — are solely responsible for negotiation, representation, contracting, payment terms, worker classification, withholding, insurance, permits, releases, and compliance with all applicable talent agency, employment, labor, tax, and professional licensing laws in their jurisdictions.

Agencies using the Platform represent and warrant that they hold, and will maintain, any licenses, registrations, bonds, representation agreements, disclosures, and legal authority required to represent talent in each jurisdiction in which they operate.

Kasted does not choose talent for brands, pitch specific talent as a representative, negotiate rates, negotiate usage rights, collect commissions from user engagements, sign contracts on behalf of users, or accept authority to bind any user to an engagement. Any rankings, search results, recommendations, badges, requests, or suggested matches are software tools only and are not procurement, representation, or professional advice.

The Platform enables users to discover one another and coordinate creative opportunities. Kasted is not a party to, and has no responsibility for, any agreement, engagement, booking, negotiation, payment, deliverable, or dispute between users, whether initiated on or off the Platform.

Kasted does not guarantee that any brief or opportunity will receive applicants, that any user will be hired, or that any party will perform or pay. Users are solely responsible for contracts, invoices, taxes, permits, releases, usage rights, insurance, travel, lodging, visas, work authorization, and legal compliance.

You must be at least 18 years old to use the Platform. By using Kasted, you represent and warrant that you are 18 years of age or older, have legal authority to enter into these Terms, and that all information you provide is accurate and truthful.

Minors may not create accounts, maintain profiles, or be submitted, suggested, or represented through the Platform unless and until Kasted launches a specific minors workflow with verified guardian consent, agency controls, and compliance with applicable child performer and privacy laws.

At launch, users may not create profiles for minors or upload portfolio content primarily featuring minors. Kasted may remove such content unless and until a minors workflow is launched with appropriate guardian consent and legal compliance controls.

You are responsible for maintaining the confidentiality of your login credentials, for all activity occurring under your account, and for keeping account information accurate and current. You may not share or sell accounts, impersonate another person or company, or create accounts using false information.

If you create or use an account on behalf of a company, brand, agency, or other organization, you represent and warrant that you have authority to bind that entity to these Terms.

Certain Platform features require a paid subscription or one-time purchase processed through Stripe. By providing a payment method, you authorize Kasted, through Stripe, to charge that payment method for the fees you select, plus applicable taxes.

Before purchase, Kasted will disclose the subscription price, billing period, renewal terms, cancellation method, and any trial conversion terms. By completing checkout, you authorize recurring charges according to the terms shown at checkout.

Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal. You may cancel your subscription at any time through account settings. Cancellation stops future renewals and does not retroactively refund charges already incurred.

Fees are non-refundable except where required by applicable law. One-time purchases, including individual brief postings or boosts, are final once used or consumed.

You retain ownership of content you upload to the Platform, including photos, videos, portfolio materials, profile content, creative works, messages, and submissions. By uploading User Content, you grant Kasted a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, display, resize, optimize, distribute, promote, and publicly display such content solely for Platform operation, improvement, marketing, and promotional purposes.

You represent and warrant that you own or control all rights necessary to upload your User Content, including rights and releases from identifiable individuals appearing in it, and that your User Content does not violate laws or third-party rights.

Kasted may provide in-app messaging, conversation threads, message notifications, application comments, and other communication tools that allow talent, brands, and agencies to communicate through the Platform.

Kasted messaging is intended for Platform-related professional communication, including briefs, applications, requests, submissions, and agency-routed workflows. Kasted may limit, disable, or condition messaging access based on account type, verification status, moderation history, or safety risk.

Messages, attachments, and conversation content are User Content, and you are responsible for what you send. Recipients may view, save, copy, screenshot, or otherwise use messages you send as permitted by law and these Terms.

Kasted may access, review, preserve, remove, or disclose message content and metadata where reasonably needed for safety, moderation, support, abuse prevention, legal compliance, dispute resolution, fraud prevention, or enforcement of these Terms.

Kasted does not grant brands, agencies, or any other user any right to use a creator’s name, image, likeness, voice, portfolio, content, or deliverables outside the Platform. Any commercial usage rights — including campaign usage, licensing, exclusivity, territory, duration, and media — must be separately agreed in writing between the parties involved.

• Harassment, threats, intimidation, stalking, discrimination, or hate speech.
• Fraud, scams, fake casting calls, or pay-to-be-considered schemes.
• Impersonation or misrepresentation of identity, credentials, or representation status.
• Uploading stolen portfolio materials, another person’s likeness without permission, or infringing content.
• Posting exploitative or unsafe requests, nudity, sexually explicit work, or non-consensual content.
• Falsely presenting AI-generated work as authentic client or portfolio work.
• Scraping, harvesting, unauthorized bots, or interference with Platform security.
• Pressuring users off-Platform to evade safety features or moderation.
• Opportunities, messages, profiles, or content involving sexual services, escorting, trafficking, coercion, adult entertainment, intimate services, or exploitation of users.

Kasted may administratively review certain brand or agency accounts and may display verification badges or approval indicators. Verification badges, manual reviews, and account approvals are limited administrative checks. They do not guarantee identity, legitimacy, safety, financial ability, licensing status, legal compliance, or professional quality.

Creative work frequently involves in-person meetings, shoots, casting calls, and travel. You are solely responsible for your own safety judgments. Kasted recommends independently verifying identity and legitimacy, using professional or public settings for first meetings, informing someone you trust of your plans, never sending money to obtain work, and treating isolation, last-minute location changes, or pressure tactics as red flags.

Kasted may offer features that use artificial intelligence or automation, such as profile assistance, brief assistance, search, ranking, matching, and recommendations. AI features may be experimental and outputs may be inaccurate, incomplete, or outdated.

AI outputs are not legal, financial, employment, hiring, or safety advice. Search, ranking, matching, and recommendation tools do not guarantee visibility, applications, bookings, or outcomes. Kasted does not make employment or hiring decisions.

Your use of the Platform is also governed by the Kasted Privacy Policy, Community Guidelines, Cookie Policy, and DMCA / Copyright Policy.

Kasted relies on third-party providers including Stripe, Supabase, Vercel, Resend, Google OAuth, and OpenStreetMap/Nominatim. Kasted is not responsible for third-party service interruptions, failures, security incidents, or availability issues.

Following account deletion, public profile visibility will be removed. Certain backend records may be retained for legal, fraud prevention, safety, billing, operational, moderation, message, abuse prevention, security, or dispute purposes.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” KASTED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND RELIABILITY.

KASTED DOES NOT GUARANTEE JOB OPPORTUNITIES, TALENT DISCOVERY OUTCOMES, PROFESSIONAL RELATIONSHIPS, USER AUTHENTICITY, IDENTITY, SAFETY, EARNINGS, PAYMENT BY ANY USER, OR BOOKINGS.

To the maximum extent permitted by law, Kasted shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, lost opportunities, reputation damage, business interruption, or data loss. Kasted’s total liability shall not exceed the greater of the amount paid by you to Kasted during the twelve months preceding the claim or one hundred U.S. dollars.

You agree to indemnify and hold harmless Kasted and its affiliates, officers, directors, employees, and agents from claims arising out of your User Content, conduct, engagements with users, use of the Platform, or violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Florida, except that the Federal Arbitration Act governs arbitration. Except as provided in these Terms, disputes arising from or relating to these Terms or the Platform shall be resolved through final and binding arbitration on an individual basis administered by the American Arbitration Association under its Consumer Arbitration Rules.

You may opt out of arbitration by emailing contact@kasted.co within 30 days of first accepting these Terms with your name, account email, and a clear statement that you wish to opt out.

To the maximum extent permitted by law, you and Kasted each waive the right to participate in class actions, collective actions, or representative proceedings of any kind.

Kasted may update these Terms periodically. Material changes will be communicated through Platform notifications or email where practicable, and the revised effective date will be posted.

If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary so the Terms otherwise remain in effect.
